Wrongful Death:
State Farm Mutual Auto Insurance v. Connolly (2006)
In this wrongful death lawsuit the Arizona Court of Appeals ruled in favor of Matt’s client (a young girl who witnessed the death of her younger sister). Through this case new law was created relating to negligent infliction of emotional distress claims.
Webb v. Gitten (2008)
Through Matt Riggs’ efforts the Arizona Supreme Court unanimously agreed the law (which was unfavorable to consumers and favorable to the insurance industry) must be changed. Matt’s victory lead to a favorable settlement for his client who lost his son due to a drunk driver.
Payton v. Henrickson Trucking, Inc. (2008-2010)
After two years of litigation, this wrongful death/trucking case settled two months before trial. Depositions were taken in Sacramento and Bakersfield.
Pini v. Main Street Station Bar & Grille (2007-2010)
After two years of litigation this wrongful death case (arising from a drunk driver) settled one month before trial.
Binette v. Hagan (2010)
Hagan failed to call “911” when his friend went unconscious after using black tar heroin. Allstate Insurance paid the limit of Hagan’s homeowners insurance.
Shields v. Banner Health
The plaintiffs alleged a missed diagnosis resulted in the death of their child. The case settled during litigation.
Mendez v. Native American Air Ambulance (2006)
Wife/mother died while being air transported from a Show Low hospital to a Phoenix hospital. The matter settled during litigation.
Smith v. Cuevas (2009-2010)
The wrongful death of the Smith’s two sons in an automobile accident settled during litigation.
